Terms & Conditions Photographic Events
This website is run by Hatch Media. Hatch Media makes the site and services available and considers use of the site as acceptance of our terms and conditions.
‘License’ means those rights in the photographs licensed to the Client pursuant to Clause 2 below. ‘Photographs’ refers to all photographic material produced by Hatch Media whether prints, digital files, or any other type of electronic or physical material. Our online ordering system is provided by Photo Stock Plus. Order fulfilment is carried out at our office in Sydney with our print partners Photo King.
2. Copyright and License to Use
Hatch Media is the sole author of the photographs. The photographs shall be the photographer’s interpretation rather than a literal re-creation of the client brief.
Hatch Media retains the entire copyright to the photographs at all times throughout the world.
b. Moral Rights
Hatch Media must be credited with the photography in any situation where the photography is used for PR purposes or in mainstream publication.
c. License to Use
• Hatch Media permits events customers a non-exclusive right to download digital images to their personal computer and create a digital library for personal, non-commercial use.
• Images may be cropped, altered or re-created into derivative works. You may also share your digital library with immediate friends and family who may also make copies and prints.
• Digital Media may not be shared beyond the conditions stated in Clause 2 of these Terms and Conditions.
• Digital Media may not be used in a defamatory or unlawful way.
• Customers may not resell their rights under this agreement or make digital media available for re-use or redistribution.
• Digital Media may not be used for Editorial, Commercial or Promotional purposes. This includes but is not exclusive of:
a). Digital Media may not be used as a template or form to make multiples of a product, presentation template, business card or any electronic or printed material without permission.
b). Digital Media may not be used as an element of a webpage, logo or trademark without permission.
3. Ownership of Materials
Title and copyright to all photographs is held by Hatch Media.
Hatch Media shall not be liable for any legal action, claim or damages resulting from the publication of the photographs or other use by the customer or client.
The customer or client shall indemnify Hatch Media against any claim or damages against including reasonable Counsel fees arising from the customer or clients use of the photographs and Hatch Media’s use of the photographs.
5. Price and Payment
• All prices are quoted on our Photo Stock Plus eCommerce platform are quoted in Australian dollars.
• Payment is required prior to product order fulfillment and can be made by credit card, debit card or any other method Hatch Media may introduce.
• Shipping and GST are not refundable.
Refunds are processed according to our Refund Policy seen below in Clause 6.
6. Refund & Cancellation Policy
If there is a fault with the media received please let us know within 14 days and we will be happy to resolve the issue. Hatch Media will endeavour to deliver prints and posters within the delivery times mentioned above. If you have not received your order within 28 days, Hatch Media will replace the goods.
The customer has a right to cancel an order in the following situations:
a). Hatch Media has not made delivery of the goods within 28 days.
b). If the goods arrive in a damaged condition. The customer must let Hatch Media know as soon as possible after the time of delivery within a 14 day period.
The wish to cancel an order should be sent via email through our contact page.
The customer is responsible for postage charges involved with returning any goods and or redelivery charges. Note that all returned goods must arrive in their original packaging and be in an unused state.
7. Delivery Policy
Hatch Media makes every effort to produce high quality digital and print imagery. Photographs are captured using professional equipment and prints are produced with our print partners Photo King using archival photographic paper.
Prints are carefully packed and posted to your desired address. If there is a fault with the prints received please let us know within 14 days.
The place of delivery will be the details provided by the customer as shown on the order. The method of delivery will be through Australia Post’s regular letter or parcel post service depending on the size of prints being ordered.
An express delivery is also available using Express Post and will usually deliver within the Australia Post ‘Next Day Delivery’ network within 1 day. Outside the ‘Next Day Network’ delivery usually occurs within 2-3 working days. Note that Express Delivery attracts higher postage charges, please enquire with the office if you need your prints via this service on 02 8970 9273.
a). Poster Delivery
Hatch Media uses Parcel Post when sending posters. Please allow up to 14 days for delivery following customer sign-off on the final poster design.
b). Prints Delivery
For prints that are 10 x 10 or 8 x 12 inches or above, Hatch Media uses an A3 mailer for safe delivery and is sent via Parcel Post.
Prints of 5 x 7.5 inches or less are sent through Regular Letter mail. Hatch Media requires 10 working days from the date of the order to the time of delivery to allow for formatting, colour correction and printing. Express Post delivery options are also available – please feel free to enquire with the office on 02 8970 9273.
c). Digital Media Delivery
File are collected and sent via the online file transfer service WeTransfer. The customer is sent a link to their preferred email address that allows the ordered files to be downloaded. Delivery of files will take place within 72 hours or less from the time of ordering.
Hatch Media will endeavour to deliver prints and posters within the delivery times mentioned above. Digital files are usually produced as high-resolution JPEG uncropped files. If you have not received your order within 28 days, Hatch Media will replace goods.
8. Security Policy
All transactions made with Hatch Media are secure and fully protected with an industry standard Secure Socket Layer (SSL) certificate. Our eCommerce platform uses industry level firewalls over secure data networks and robust password protection measures.
Our payment gateway is provided by SecurePay who operate under the international guideline Payment Card Industry Data Security Standard (PCI DSS).
Transactions are also examined for evidence of unusual buying behaviours. This may include large quantities of our products being ordered per person or household. Similarly, multiple or unusually large transactions on a single credit card over a short time will be carefully reviewed.
Other billing inconsistencies including different shipping and billing addresses, multiple cards using a single delivery address or a single card using many different shipping addresses will also be closely examined.
9. Suspension or Termination
Hatch Media is pleased to offer our eCommerce platform to our customers. However, we reserve the right to or refuse payment, suspend or terminate your account for any of the following reasons:
a). You are in breach of our terms and conditions
b). You act in a way that is inconsiderate to our community.
We may at our discretion limit or cancel quantities ordered per person or per household. This may include multiple or unusually large transactions on a single credit card over a short time.
Billing inconsistencies including different shipping and billing addresses, multiple cards using a single delivery address or a single card using many different shipping addresses.
10. Notification of Changes
Use of the site constitutes acceptance of our current Terms and Conditions. Hatch Media reserves the right to revise the Terms and Conditions. Any changes are not retro-active, however our current Terms and Conditions will guide the relationship with our customers and clients.
Prices for our products are listed in our products page and also during the ordering process. These prices are fixed, however Hatch Media does reserve the right to change pricing without notice.
11. Entire Agreement
These Terms represent the Entire Agreement between the two parties with respect to the subject matter and no alteration, modification or interpretation hereof shall be binding unless in writing and signed off by both parties.
